1. Agreement
These Terms of Service (“Terms”) govern your access to and use of the website, checkout flow, and related services operated under the GuateSIM brand (“GuateSIM”, “we”, “us”, “our”) (collectively, the “Services”). The Services are provided by El Consumidor Feliz S.A., which operates the GuateSIM brand. By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
You must be at least the age of majority in your place of residence (or older if required locally) and have legal capacity to enter a binding contract. If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization.
2. The service
GuateSIM offers prepaid travel eSIM data plans intended for use in connection with travel to the regions we cover—including, but not limited to, Guatemala—subject to plan descriptions, network coverage, and technical compatibility shown at purchase. Plans are delivered digitally (for example via QR code or activation instructions). We resell or distribute connectivity in cooperation with underlying network and eSIM platform partners; service quality, coverage, speeds, and availability depend on those third parties and local conditions.
3. Orders, pricing, and payment
Prices, taxes, and fees are shown before you complete payment unless otherwise stated. We use third-party payment processors (such as Stripe). You authorize us and our processors to charge your selected payment method for the total amount shown. You represent that payment information is accurate and that you are authorized to use the payment method.
We may refuse or cancel orders in cases of suspected fraud, errors in pricing or description, inventory or provisioning limits, or other legitimate business reasons, in which case we will refund any amount already charged where applicable.
4. Delivery and activation
After successful payment, we will make reasonable efforts to deliver eSIM credentials and instructions through the Services (for example on an order confirmation page or by email, depending on configuration). You are responsible for compatible hardware and software, correct installation steps, and enabling required settings (such as data roaming on the eSIM line where applicable). Validity and data allowances generally start according to the plan terms communicated at purchase (often when the eSIM first connects to a supported network—see product copy on our site).
5. Refunds and cancellations
Because eSIM profiles are digital goods that can be delivered and activated quickly, all sales are final except where mandatory consumer laws require otherwise or we expressly agree in writing.
If provisioning fails through no fault of yours, or we cannot deliver the purchased plan, we will work with you in good faith, which may include re-issuance or a refund at our discretion. Chargebacks should be a last step after contacting info@guatesim.com.
6. Acceptable use
You agree not to:
- Violate applicable laws or third-party rights;
- Use the Services to harass, abuse, or harm others;
- Attempt to gain unauthorized access to our systems, other users’ data, or partners’ networks;
- Interfere with or disrupt the Services, circumvent security, or scrape the site in violation of these Terms;
- Misrepresent your identity or misuse payment methods.
We may suspend or terminate access for violations or risk to the Services or others.
7. Intellectual property
The Services, including branding, text, graphics, and software, are owned by us or our licensors and are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Services for personal or internal business travel purposes as intended. No other rights are granted.
8. Third-party services
The Services rely on third parties (payment processors, eSIM platforms, mobile operators, hosting providers). Their terms and privacy policies may apply to you. We are not responsible for third-party services outside our reasonable control.
9. Disclaimers
The Services and connectivity are provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted service, specific speeds, or coverage in all locations.
10. Limitation of liability
To the maximum extent permitted by law, neither GuateSIM nor its suppliers or partners will be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or business opportunities, arising out of or related to the Services or these Terms, even if advised of the possibility. Our aggregate liability for claims arising out of or related to the Services or these Terms is limited to the greater of (a) the amount you paid us for the specific order giving rise to the claim in the twelve (12) months before the claim, or (b) one hundred U.S. dollars (USD $100), except where prohibited by law.
11. Indemnity
You will defend, indemnify, and hold harmless GuateSIM and its affiliates, officers, and agents from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, violation of these Terms, or violation of third-party rights, to the extent permitted by law.
12. Changes
We may modify these Terms by posting an updated version on this page and updating the “Last updated” date. If changes are material, we may provide additional notice where appropriate. Continued use after changes become effective constitutes acceptance of the revised Terms, except where applicable law requires otherwise.
13. Miscellaneous
If any provision is held invalid, the remainder remains in effect. Failure to enforce a provision is not a waiver. These Terms constitute the entire agreement regarding the Services and supersede prior understandings on the same subject. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
